That wouldn't work because Ben was working closely with Snyder, and they agreed that in this universe Dick Grayson had been dead for years. Geoff Johns wanted to retcon that it was Jason Todd who died to make it more comic accurate.
Ultimately, Johns got a victory because his comics were a major inspiration for The Batman
