in this case, derryn hinch, an alcoholic fuckwit broadcaster shock jock, repeatedly named a pedophile while courts explicitly told him NOT to do this, because it would taint juries. defiant of this, hinch continued to do this, and a lower court let the pedo out on bail where he re-offended and molested another 14 minors in that time before the case was brought back before the high court.
tldr; the high court of australia said the books weren't closed on dismissing trials because of adverse pre-trial publicity, but it would not occur here, although it could certainly happen to evidence (and has in other cases).
Australia uses a system of English law, US uses French/Roman if i am not mistaken, ours is adversarial, yours inquisitorial (judges can ask questions).
